Law is one of the fundamental structural features of society. It regulates almost the entire everyday life including highly personal and sensitive areas of life such as gender, sexuality, love, family, career or political co-determination. The law assume certain ideas of corporality and desire - without, however, being sufficiently transparent. German jurisprudence has only recently opened up to questions of gender research. The course content will focus on the importance of the category "gender" for law and, vice versa, on the influence of law (usually understood as impartial and neutral) on gender relations.

Learning objectives:
The aim of the course is to supply the students with an overview of legal debates on gender. Students should be empowered to contextualise laws or rulings and to develop and defend their own position. At the same time, the course also focusses on knowledge of one's own (subjective) rights and the competence to mobilise them. While law often appears impartial and neutral for those who benefit from it, it is a highly political concern for others. The purpose of the course is to raise awareness of social inequalities (in law) and the ability to reflect on one's own privileges.

Didactic concept:
The course content is drawn from all three main areas of German law (civil law, public law and criminal law), European law and international law as well as legal gender studies. In addition to a legal dogmatic perspective that systematises the prevalent application of law, a legal critical perspective is a constant companion and common thread. Legal criticism can take both an internal and an external perspective.

The aim is to hold the event in attendance. Depending on the pandemic situation, the event can also be held digitally at any time.

In order to be able to structure the new subject matter appropriately, the event will first distinguish between legislation, legal practice and science. In the case of legislation, the focus is on normative regulations and their historical development processes. In legal practice, the focus is on legal cases. The function and mode of operation of the Federal Constitutional Court and the Federal Court of Justice are examined in particular. In terms of science, the focus will be on legal gender studies, as well as on traditional, conservative approaches to jurisprudence. Over the course, the interconnection between lawmaking, legal practice and academia becomes increasingly clear and topics (e.g. quota and parité) replace the former structure of the course.

At the beginning of each unit, the class develops a common basis for discussion. The starting point can be a text (excerpt), a video (excerpt) or a short lecture. The course includes academic sources and court decisions as well as pop culture evidence. All units are structured in a way that there is sufficient time for discussion and exchange. The lecturer assumes - in addition to introductory impulse lectures - a commentary moderating function. Concrete tasks such as independently writing an (alternative) law or a reader's letter invite the students to participate.

The key qualification consists of a seminar weekend (Friday - Sunday) and a follow-up meeting.

Additional examination information:
In addition to constant attendance, the certificate requires active participation and the preparation of a written reflection report as well as a short presentation within the framework of the follow-up meeting. Absences may amount to a maximum of 20%.
