Consumer protection law is an important pillar of private law in the European Union. It has become one of those areas of law that are strongly influenced by EU law and, as one of the central harmonization goals of the European Union, forms an important balance in relation to the internal market orientation of the European Union. In addition to the primary legal guarantee of consumer protection (e.g.: Art. 38 Charter of Fundamental Rights of the EU), a large number of consumer protection directives have been issued in recent decades, of which only a few are mentioned here by way of example:
- Directive on unfair terms in consumer contracts 1993,
- Consumer Sales Directive 1999,
- Timeshare Directive 2009
- Passenger Rights Directive 2004, 2007, 2010 and 2011
- Consumer Rights Directive 2011
- Consumer Credit Directive 2008 and 2014
- Mortgage Credit Directive 2016
The course establishes a connection between selected examples of these directives on consumer protection and the basic questions of EU law. In doing so, it touches on legal, economic and sociological facets of EU law.
Learning objectives:
This is an opportunity for students to take an in-depth look at a topic that is as current as it is relevant from an academic perspective.
Didactic concept:
The analysis of the content of the course itself will be accompanied by presentations on the selected topics, mainly on topics from the list uploaded at the beginning of the semester, or - after prior consultation - by means of own topics that are suitable.
Literature:
Literature references will be mentioned as part of the first course.
Additional examination information:
Students are required to present a paper on a selected topic and submit a written paper on the topic at the end of the semester.
