Short description: The international law of the sea regulates the protection and uses of the oceans, which cover more than two thirds of the Earth's surface. The lecture focuses on the rules and institutions of the United Nations Convention on the Law of the Sea (UNCLOS or LOSC) and places the achievements of this international treaty in a historical and current context. In particular, the foundations and sources of the law of the sea, the zonal approach on which the LOSC is based, and the regimes of the individual maritime zones will be addressed. In addition, the delimitation of overlapping maritime boundaries, rights and freedoms of use, and questions of management and exploitation of living and non-living marine resources are dealt with. On the other hand, marine environmental protection and the peaceful settlement of disputes are subjects of the lecture "International Law of the Sea II", which takes place in the summer semester.

Please note: The course is offered in English. It is aimed at students of SPB XII (Maritime Business Law), but also at those of SPB X (European and International Law). It is also open to all other students who are interested in the international law of the sea. Exchange students from abroad are particularly welcome to participate.

Recommended textbook literature: Y. Tanaka, The International Law of the Sea, 3rd ed., Cambridge 2019; D.R. Rothwell / T. Stephens, The International Law of the Sea, 2nd ed., Oxford 2016. An up-to-date textbook in German is not available (but see W. Graf Vitzthum (ed.), Handbuch des Seerechts, Munich 2006); an introduction is offered by A. Proelß, Raum und Umwelt im Völkerrecht, in: W. Graf Vitzthum / A. Proelß (eds.), Völkerrecht, 8th ed., Berlin 2019, pp. 463 et seq. A detailed script (in English) will be provided during the course.

Students are required to bring an English text version of the United Nations Convention on the Law of the Sea, which is freely available on the internet.

The lecture is offered as a face-to-face course within the framework of the applicable legal requirements. The aim is to record the lecture on video. The recording can then be streamed in parallel and/or accessed afterwards.
