Restorative justice is a philosophy of social peace, an alternative way of looking at and dealing with criminal behaviour. It is conceived both as a supplement to traditional criminal law and as an alternative. The core of restorative justice is a changed understanding of criminal offences as violations of persons and relationships and the active involvement of the persons actually involved in the conflict - "victims" and "perpetrators" - in conflict resolution.

In the seminar, the philosophy of restorative justice as well as the legal framework in Germany will be presented. The procedure of victim-offender mediation, which is mainly used in Germany, will be concretised and the chances and risks of such mediation in criminal cases will be discussed. A discussion of empirical research results with German and international reference serves as a basis for an assessment of the possibilities and limits of restorative justice. We will also take a look at restorative procedures used in other regions of the world. 

Learning objectives:
The seminar serves to give an overview of the ideas, legal framework, practical forms of implementation and empirical findings on restorative justice.

Students will be able to describe the theoretical foundations and the process of restorative justice procedures.

The students are able to analyse the possibilities and limits of restorative justice.  

The students are able to illustrate the processing of a concrete case (criminal offence) in both the criminal law and restorative system (in outline). 

Didactic concept:
The seminar is designed as a block seminar in presence. The work in the seminar is literature-based, i.e. for each date (including the first) selected texts are to be read. The texts serve as the content basis for our discussions. In addition, we will watch excerpts from some documentaries on restorative justice. Some film material as well as some texts are in English.
There will be input from me, but also different group work phases and plenary discussions. 
On the first date you will divide into small groups, each of which will prepare a short creative introduction for a specific topic on the weekend in December.

The seminar plan as well as the texts to be read will be posted in STiNE in the last week of September.
