The European Court of Human Rights (ECtHR) has repeatedly stated that freedom of expression “constitutes one of the essential foundations of a democratic society and one of the basic conditions for its progress and for each individual’s self-fulfilment”. The course will teach what this fundamental freedom, stipulated in the article 10 of the European Convention on Human Rights (ECHR) entail and what is its scope of protection under the European Court of Human Rights’ jurisprudence (case law).
This course aims to give an insight into the scope of protection of Freedom of expression within the framework of the ECHR. It will start with a brief introduction on the ECHR and the functioning of the ECtHR and proceed by the interpretation of freedom of expression provision in the light of the ECtHR case law, introducing its key concepts, legal grounds and the criteria of assessment used in the examination of the cases. The course will mainly focus on the analysis of the landmark Freedom of expression cases.
