Comments/contents: The course provides a comparative overview over the foundations of the modern Japanese law. The focus is on civil, commercial and economic law as well as on constitutional law and out of court settlement of conflicts. Special emphasis is laid on the historical development of law in Japan which was influenced first, by European law after 1868 and second, by US law after 1945. The cultural, sociological and economic framework that shapes the modern Japanese law is analyzed in an interdisciplinary approach. It is the synthesis of different legal traditions that makes a comparison of law with Japan and its mixed legal order highly rewarding. For each session introductory English and German legal materials will be supplied on STiNE.
