Course Content:
The international normative framework as a whole has undergone quite substantial changes over the past decades. While previously comprising basically only a set of rules – often merely of a procedural nature – having the purpose to limit and guide states as the sole subjects of international law in their interactions with each other, public international law has more recently transformed into what has already been called a “comprehensive blueprint of social life” or the evolution of a “world (internal) law”. In the course of this process, the international legal order is more and more independent of the will and interests of individual states, with its substantive norms increasingly focussing on the realization of community interests, among the protection of human rights and the environment, the realization of core labour and social standards as well as – closely related with these issues – the promotion of sustainable management. Already in light of its ever-growing importance, the development of this international normative framework on sustainable management has always been and continues to be a fascinating and complex subject of study.
In light of this finding, this course gives students an insight into the public international law background as well as the central features of the international normative framework on sustainable management. Among the topics introduced and discussed are the evolution and the sustainability-oriented characteristics of the current international legal system as well as the main normative steering instruments and primary steering subjects in the transnational normative order and their relevance in the context of sustainable management. Furthermore, the course will address the challenging questions surrounding the perception of private business actors as addressees of international sustainability obligations under treaty law and customary international law. In addition, two specific reference fields will be covered, namely sustainable management as a topic of international investment law and sustainability as a regulatory object of regional economic integration agreements.
Lernziel:
Students should develop an understanding of the central issues surrounding the international normative framework on sustainable management including its transnational legal background, the role of private actors in the international framework for sustainable management, and the specific role of law in maintaining sustainability initiatives in economic contexts.
