Kommentare/ Inhalte: The course offers attention to different comparative theories and methodologies, as well as to study of foreign legal systems. We will look at similarities and differences in contract law between Civil Law jurisdictions and Common Law ones. The course will provide students with the possibility to get advanced knowledge about the sources, general principles and characteristics of contract law in a comparative perspective. In order to achieve these aims the course proceeds as follows:

1. Methodology and comparative analysis

2. The concepts of legal families and legal traditions

3. What is a contract? 

4. Bargain contract: Intent, Promise and Consideration

5. Contract Formation: Offer and Acceptance

6. Terms of Contract: Interpretation, Good faith

7. Avoidance of Contracts: Promissory Estoppel, Capacity, Fraud, Mistake, Illegality, Duress and undue influence

8. Non-performance and Breach: impossibility, frustration

9.  Contract Remedies: damages and penalties.

 
Vorgehen:
Für einen reibungslosen Ablauf benötigen Sie eine stabile Internetverbindung und ein Arbeitsgerät mit  funktionierendem Mikrofon und einsatzbereiter Kamera.
Dies ist für die Teilnahme an einer interaktiven Lehrveranstaltung obligatorisch.
Zusätzliche Hinweise zu Prüfungen: All sessions will require an active participation. Furthermore, it provides for individual in-depth analysis on selected topics of choice in a written paper (a 1500-word essay) or 15-20 min. presentation.

Credits may only be acquired, if the student’s absence does not exceed 20%. Non-Registered students are welcome to come to first class and could receive a place, if listed students do not attend.
